Ticket conditions

The ticket is the contract of carriage for the passenger and baggage, which is also subject to the 'General Conditions of Carriage'. These conditions are subject to the applicable law.

Important notice

We recommend that passengers do not leave valuables or documents in checked baggage. The carrier will not be liable for any damages beyond the legally established limits. Passengers may benefit from a higher liability limit by making a special declaration, at check-in, and by paying an additional fee.

Passengers must examine this ticket, especially the check-in deadline and the contract conditions. Please, look over the timetables in advance of the flight's departure.

The "flight check-in deadline" refers to the deadline for accepting the passenger on the flight as per the departure time shown on their ticket and before which the passenger must have been admitted to the flight after having checked their baggage and received their boarding pass. Once the established deadline has expired, check-in will be closed, and the Company will not incur any liability for denying boarding to any passengers arriving after said deadline. Furthermore, it may assign the unused seat to any passengers waiting on stand-by.

 

Due to increased airport security and in the interest of flight punctuality, unless otherwise specified, the boarding deadline will be a minimum of 60 minutes prior to scheduled departure for intercontinental flights* and 45 minutes for all domestic and European flights**. Local regulations may set a different time limit for passengers with special needs.

* With the exception of San Pedro Sula and Santa Cruz de la Sierra which are 90 minutes and Caracas which are 120 minutes.

** With the exception of Amsterdam which is 60 minutes.

Due to the booking and seat control procedures of regular airlines, situations may arise circumstantially in which, due to a lack of seats on the booked flight, a passenger may be denied boarding, despite having a ticket with a confirmed seat.

Council Regulation (EC) no. 261/2004, of 11 February 2004, establishes common standards to compensate airline passengers in cases of denial of boarding, major delays and cancellations.

The air carrier will also provide any passenger who has been refused boarding or has been affected by cancellation or delay for more than two hours with a form indicating their rights, especially in terms of compensation and assistance, if they so require. Should any passenger require any additional clarification related to the application of this regulation, they have the option of addressing the Ministry of Public Works, Directorate General of Civil Aviation, Sub-Directorate General of Air Carriage, User Services. Paseo de la Castellana, 67, 28071 - Madrid (Spain).

The rights corresponding to the passenger will be of a strictly personal nature, and they may not be transferred to another person.

In accordance with the Montreal Convention and Regulation (EC) 2027/97, there is no financial limit set for liability in case of passenger injury or death. For damages of up to 128,821 SDRs (approximately 159,042 euros), the airline cannot contest compensation claims. Above this amount, the airline can only contest a claim if it can prove that it was not negligent or otherwise at fault.

However, if the company proves that the damage has been caused by negligence on the part of the injured or deceased passenger, and the damage contributed to the said injury or death, AIR EUROPA LÍNEAS AÉREAS may be wholly or partially exempted from its liability in accordance with applicable law.

In the event of death or injury to a passenger, the airline must pay, within fifteen days of the identification of the person entitled to compensation, an advance to cover immediate economic needs. In the event of death, this advance may not be less than 16000 SDRs (approximately 19,754 euros).

In accordance with the provisions of the Montreal Convention and Regulation (EC) No. 2027/97, AIR EUROPA LÍNEAS AÉREAS S.A.U. will be liable in case of destruction, loss or damage to baggage up to the amount of 1,288 SDRs (approximately 1,590 euros). With respect to checked baggage, it is liable even when not at fault, unless the baggage was already damaged or the damage is due to the nature of the baggage or a defect or flaw. With regard to unchecked baggage, the airline is only liable for damage caused by it.

In the event of baggage delay, AIR EUROPA LÍNEAS AÉREAS S.A.U. is liable for damage provided that it has not taken all reasonable measures to prevent the damage or it has been impossible for it to take such measures. Liability in the event of baggage delay is limited to 1,288 SDRs (approximately EUR 1,590).

Passengers may benefit from a higher liability limit by making a special declaration, at the latest at check-in, and by paying an additional fee. This declaration cannot be made on certain types of valuable objects.

The carrier will not assume liability for the transport of fragile or perishable objects beyond the legally established limits. If the checked baggage has been damaged, delayed, lost or destroyed, the passenger must write to the airline as soon as possible. If the damaged baggage is checked baggage, the passenger shall indicate it in writing within seven days, and in the event of delay, within twenty-one days, in both cases from the day on which the baggage was made available to the passenger.

1. The use of this ticket and baggage receipt will be only for AIR EUROPA flights from the departure airport to the destination airport, in accordance with the routes and dates indicated thereon.

2. For the purposes of this contract, "Ticket" means a passenger ticket and baggage receipt, which form part of these conditions and notices; "Carrier" means any air carrier that transports or agrees to transport the passenger or their baggage under this contract; "Montreal Convention" means the Convention for the Unification of Certain Rules for International Carriage by Air, signed in Montreal on 28 May 1999; "Regulation (EC) 2027" means Council Regulation (EC) 2027/97, of 9 October 1997, on the liability of airlines for carriage by air of passengers and their luggage, as amended by Regulation (EC) No 889/2002. "Air Navigation Act" means Act 48/1960, of 21 July, on Air Navigation, and includes the subsequent modifications.

3. The carriage performed under this contract is subject to the rules and limitations relating to liability established by the Montreal Convention, Regulation (EC) 2027/97 and, where applicable, the Air Navigation Act, amended by Royal Decree 37/2001 or any other applicable amendment. These rules and limitations are summarised in the Information Notices contained in this contract.

4. Insofar as it does not contradict the previous paragraph, all carriage and other services rendered by each carrier will be subject to: i) The provisions shown on this ticket, ii) the applicable fares, iii) the conditions of carriage established by the carrier and the related regulations which form part of this contract (which may be consulted at the carrier's office) in the event of carriage between a point in the United States or Canada and any point outside those countries, where the rules in force will apply.

5. The carrier's name may appear abbreviated on the ticket, provided that the full name and abbreviation appear in the carrier's manuals, transport conditions, regulations or timetables and on all ticket coupons. The agreed stopovers are the points indicated on this ticket or which appear on the carrier's timetables as the scheduled stopovers in the passenger's itinerary. Under this contract, carriage performed by several successive carriers will be considered as a single operation.

6. Any carrier that issues a ticket for carriage on behalf of the other carriers acts only as an agent of the carrier.

7. The exemptions or limitations of liability corresponding to the carrier which appear on this ticket will apply to its agents, employees and representatives, as well as to any person whose aircraft the carrier uses in the execution of the carriage and its agents, employees and representatives.

8. Checked baggage will be delivered to the holder of the baggage receipt. In the event of damage to baggage during carriage, the appropriate claim must be submitted to the carrier immediately after discovering the damage and, at the latest, within 7 days of having it returned; in the event of delay, the claim must be filed within 21 days of the date on which the baggage was returned.

9. The ticket is valid for one year from the date of issue, unless otherwise indicated on the ticket, in the carrier's fares or in the conditions of carriage, and only for the route and the dates indicated. An unused ticket is not transferable, endorsable or refundable, and no modifications to it will be accepted when it becomes "OPEN" after having been issued. The carrier may refuse carriage in the event of non-payment of the applicable fare.

10. The carrier will transport the passenger and their luggage with the maximum possible diligence. When necessary and with prior notification, except for exceptional circumstances that prevent it, the carrier may be replaced by other carriers and use other aircraft. The carrier assumes no responsibility for guaranteeing connections with other flights or other types of transport.

11. The passenger must comply with the Government requirements for the trip and present the required departure and entry documents, and other required documents, as well as arrive at the airport at the time indicated by the carrier or, if none has been set, sufficiently in advance to complete the departure procedures.

12. No agent, employee or representative of the carrier will have authority to alter, modify or waive any of the provisions of this contract.

13. REFUNDS - Air Europa will apply a fee of 18 euros for refunds, unless it is an involuntary refund in accordance with the provisions of the Conditions of Carriage (Condition 2) or any other to which it is obliged for reasons expressly established by current legislation. "

With the entry into force of the Convention for the Unification of Certain Rules for International Carriage by Air, signed in Montreal on 28 May 1999 (the Montreal Convention) and, consequently, the new wording of Regulation (EC) No 2027/97 being applicable [as amended by the Regulation (EC) no. 889/2002], there are new rules regarding the carrier's liability in relation to passengers and their luggage for both domestic and international flights.

The Conditions of the Contract of Carriage (ticket) and the Baggage Coupon, as well as the provisions of any other document related to them or to the carrier's liability towards the passenger, shall apply provided that they do not conflict with the aforementioned Montreal Convention and Regulation (EC) 2027/97.

This notice summarizes the liability rules applied by community air carriers in accordance with community law and the Montreal Convention.

 

Compensation in the event of death or injury

There is no economic limit for liability in the event of injury or death of the passenger. For damages of up to 128,821 SDRs (approximately 159,042 euros), the airline cannot contest compensation claims. Above this amount, the airline can only contest a claim if it can prove that it was not negligent or otherwise at fault.

 

Advances

In the event of death or injury to a passenger, the airline must pay, within fifteen days of the identification of the person entitled to compensation, an advance to cover immediate economic needs. In the event of death, this advance may not be less than 16000 SDRs (approximately 19,754 euros).

 

Passenger delay

In the event of passenger delay, the airline is liable for damage provided that it has not taken all reasonable measures to prevent the damage or that it has been impossible for the airline to take such measures. Liability in the event of a passenger delay is limited to 5,346 SDRs (approximately 6,600 euros).

 

Baggage delays

In the event of baggage delay, the airline is liable for damage provided that it has not taken all reasonable measures to prevent the damage or that it has been impossible for the airline to take such measures. Liability in the event of baggage delay is limited to 1,288 SDRs (approximately 1,590 euros).

 

Destruction, loss or damage to baggage

The airline is liable for destruction, loss or damage to baggage up to the amount of 1,288 SDRs (approximately 1,590 EUR). With regard to checked baggage, it is liable even when it is not at fault, unless the baggage is already damaged. With regard to unchecked baggage, the airline is only liable for damage caused by it.

 

Higher limits for baggage

Passengers may benefit from a higher liability limit by making a special declaration, at the latest at check-in, and by paying an additional fee.

 

Baggage claims

If the checked baggage has been damaged, delayed, lost or destroyed, the passenger must write to the airline as soon as possible. If the damaged baggage is checked baggage, the passenger shall indicate it in writing within seven days, and in the event of delay, within twenty-one days, in both cases from the day on which the baggage was made available to the passenger.

 

Liability of the company with which the service has been contracted and of the company in charge of the effective provision. 

If the airline responsible for the flight is not the same as the contracting airline, the passenger may file a complaint or a claim with any of them. If the ticket contains the name or code of an airline, that is the contracting airline.

 

Claim deadlines

Any claim before a court must be made within two years of the arrival of the aircraft or of the day on which the aircraft should have arrived.

 

Basis of information

The above rules are based on the Montreal Convention of 28 May 1999, implemented in the Community by Regulation (EC) No 2027/97 [as amended by Regulation (EC) No 889/2002] and by the national legislation of the Member States".

This ticket is issued by Air Europa Líneas Aéreas S.A.U., acting as Air Europa and accepted by the passenger subject to the Contract Conditions, including all notices and notifications.

If, for any reason, passengers cannot make the trip as planned, they must inform the Carrier or its Agent as soon as possible.

Air Europa Líneas Aéreas S.A.U., acting as Air Europa, is the Carrier only when the initials "UX" or "AEA" appear in the "Carrier" box of the flight coupon(s). Any other initial in this box means the Carrier is another company; details will be provided to anyone who requests them. Air Europa will inform passengers about the identity of the airline operators in the contracted airline carriage services in compliance with article 11.6 of Regulation (EC) 2111/05. The baggage conditions, special requirements, etc., for journeys operated by another carrier will be governed by the conditions of carriage of the operator company.

 

Prohibited items

Current legislation prohibits the carriage by air of a series of items, including flammable, explosive, corrosive, oxidizing, radioactive or magnetic materials, as well as pointed, sharp or other objects that can cause injuries. A non-exhaustive list of items that may not be carried into restricted security areas and aircraft cabins, in accordance with Regulation (EC) no. 622/2003, as amended by Commission Regulation (EC) no. 68/2004 and any future amendments that may become applicable, will be made available to the passenger upon request.   • Smoking is prohibited in all compartments of all Air Europa Líneas Aéreas S.A.U., including the toilets, especially during take-off and landing, unless otherwise indicated.

Hand luggage

For safety reasons on board, only one piece of hand luggage per passenger is allowed in the aircraft cabin, with maximum dimensions not exceeding 55x35x25 cm (or 115 linear cm adding length, width and height) and maximum weight of 10 kg in Economy class and 14 kg in Business class. These dimensions include handles, straps, pockets, wheels and any other items that protrude from the luggage.

Additionally, the following items, which are not subject to extra baggage charges, may be carried in the cabin:

  • A handbag or small purse
  • A coat, raincoat, cape or travel blanket
  • An umbrella or walking stick
  • A pair of crutches
  • A small camera, small video camera, binoculars or small laptop.
  • A portable cot or a wheelchair that can be folded-up completely.
  • Reading material for the trip

 

Restricted hand luggage

There are security measures adopted by the European Commission that restrict the amount of liquids or substances of similar consistency that passengers can carry with them when passing through security checkpoints at EU airports. For the purposes of these measures, the following are considered liquids: water and other drinks, perfumes, gels, aerosols, creams, lotions, oils, toothpaste, foams, deodorants or anything of similar consistency.

 

Portable electronic devices

Passengers must not use any portable electronic devices during the flight, such as radios, mobile phones, laptops or recorders, due to possible interference with the aircraft's electronic equipment. Some electronic devices may be used with crew authorisation.

 

Taxes, duties and fees imposed by the government

The price of this ticket may include taxes, duties and fees on air carriage put in place by government authorities. These taxes, duties and fees, which may make up a significant portion of the cost of the carriage by air, may be included in the fare or set aside in the "TAX/DUTY/CHARGES" box of the ticket. Passengers may also be required to pay legally established taxes, duties and fees that have not been charged previously.

 

Security controls

In most airports, security checks of passengers and their hand luggage are carried out prior to boarding, where sharp objects or any other objects that could be considered dangerous are removed. To avoid any inconvenience, we recommend transporting these items inside checked baggage. Any passenger who accepts pieces of baggage from other passengers to be transported as part of their own baggage allowance or accepts packages to be placed in their own baggage, is in violation of security measures, may be denied boarding and may be reported to airport security authorities.

Air Europa will only carry the passenger whose name appears on the ticket, and it may ask the passenger to present their identification (National Identity Document, Passport or equivalent). All passengers who wish to travel to the USA and are members of a group that does not require a visa must submit their details via the Electronic System for Travel Authorization (ESTA) starting on 12 January 2009.
